Terms of Service

These are the terms for using BotForeman. We tried to keep them short and in plain words. By signing up for or using our services, you agree to them. Our Privacy Policy is part of these terms. Questions: [email protected].
1. Who we are
"BotForeman," "we," and "us" mean BotForeman LLC, a Utah limited liability company, at 1290 South Carriage Lane, Antimony, UT 84712. "You" means the person who signs up, or the business they sign up for. If you sign up for a business, you confirm you are allowed to agree to these terms on its behalf.
2. What we do
We install, personalize, and support AI assistants for individuals, families, and small businesses. Each assistant runs on Hermes Agent software on a computer we manage. You talk to it over Telegram or another messaging service you choose, such as WhatsApp, and, if you choose, it can also work with your email and your calendar. What an assistant can do depends on the AI provider you use and the accounts you connect, and it may change as those services change.
3. Who can sign up
You must be at least 18 to sign up and pay. If you set up an assistant for someone else in your family or business, including a child, you are responsible for making sure they use it in line with these terms.
4. Your accounts with other companies
Your assistant uses services from other companies: an AI provider you choose (such as OpenAI's ChatGPT or xAI's Grok), Telegram, and any accounts you connect, such as Microsoft, Google, or WhatsApp. Those accounts belong to you. Their own terms apply, and any fees they charge, such as a ChatGPT subscription, are yours to pay. We are not responsible for those companies' outages, rule changes, usage limits, or decisions about your account with them.
If we choose to give your assistant a backup AI model for times when your own provider is unavailable, that is a courtesy at our sole discretion, not part of what you pay for. We may change or stop it at any time, and we do not provide one if you have not paid your own AI provider. Our Privacy Policy explains how backup models handle your conversations.
Keep your sign-in details for those accounts to yourself. If you think one of them has been misused, change the password and tell us.
5. Fees, billing, and canceling
- Prices. Our current prices are on botforeman.com, or in a written quote from us. Plans are a one-time setup fee plus a monthly fee for each assistant, unless an offer says otherwise.
- Payment. Payments are processed by Stripe. Your receipts and billing emails may come from Link, Stripe's payments service. Any sales tax that applies is calculated and shown at checkout.
- Renewal. Subscriptions renew each month, or each year if you paid a year up front, until you cancel.
- Free trials. If an offer includes a free trial and you cancel before it ends, you are not charged.
- Canceling. You can cancel at any time using the "Manage or cancel your subscription" link on our website, or by asking Iris or emailing us. Your service continues until the end of the period you have already paid for, and then stops.
- Refunds. Setup fees are not refundable once we have started building your assistant, and we do not refund partial months, except where the law requires it or we agree otherwise.
- Price changes. If we change the price of your plan, we will tell you at least 30 days before the new price applies to you.
6. AI can make mistakes
Your assistant uses artificial intelligence. AI can be wrong, incomplete, or out of date, and it can misunderstand what you meant. Check anything important before you rely on it, especially before your assistant sends an email or does something on your behalf.
- Your assistant is not a doctor, lawyer, accountant, or financial advisor, and what it says is not professional advice.
- It is not an emergency service and does not monitor health or safety. In an emergency, call 911.
- You are responsible for what you ask your assistant to do and for the actions you allow it to take, such as emails it sends for you.
7. Using your assistant responsibly
Please do not use BotForeman or your assistant to:
- break the law, or help anyone else break it;
- harass, threaten, deceive, or spam anyone;
- get into accounts or information you are not allowed to access;
- try to get into our computers, or into another customer's assistant;
- resell our service without a written agreement with us.
If an assistant is being used this way, we may pause it while we sort it out with you.
8. Your content
Your messages, files, and data stay yours. You give us permission to handle them only as needed to provide, support, and secure your service, as described in our Privacy Policy. What your assistant writes or makes for you is yours to use, subject to the terms of your AI provider.
9. Our name and software
The BotForeman name, logos, website, and our setup and support methods belong to BotForeman LLC. Hermes Agent and other software your assistant uses are provided under their own licenses.
10. Keeping it running
Keeping your assistant working is our job, and we watch for problems. Still, we cannot promise it will never be interrupted. It depends on the internet, power, and other companies' services, and we sometimes need to pause it briefly for updates and repairs. When your assistant is down for a while, we will tell you.
11. Ending the service
You can cancel at any time, as described in section 5. We may suspend or end your service if you do not pay, if you break these terms, or if we stop offering the service. Where it is reasonable, we will give you notice first and a chance to fix the problem. When your service ends, we handle your information as our Privacy Policy describes, and we will send you a copy of your data if you ask.
12. No warranty
We provide BotForeman "as is" and "as available." We work hard to do a good job, but as far as the law allows, we make no promises beyond those written in these terms. That includes any implied promise that the service will fit a particular purpose, will be free of errors, or will never be interrupted.
13. Limits on our liability
As far as the law allows:
- We are not responsible for indirect or follow-on losses, such as lost profits, lost business, or lost data.
- We are not responsible for losses caused by other companies' services, or by relying on AI output without checking it.
- Our total responsibility for any claim is limited to what you paid us in the 12 months before the claim.
Some places do not allow these limits. Where that is the case, they apply only as far as the law allows.
14. Utah law and resolving problems
If something goes wrong, please contact us first at [email protected]; most problems can be fixed with a conversation. These terms are governed by the laws of the State of Utah. Any legal dispute will be handled in the state courts for Garfield County, Utah, or the federal court for the District of Utah, unless the law where you live gives you the right to bring it elsewhere.
15. Changes to these terms
If we change these terms, we will post the new version here with a new effective date. If a change is significant, we will tell current customers by message or email before it takes effect. If you keep using the service after that, the new terms apply.
